Does New Mexico Have Medical Marijuana Reciprocity?

New Mexico now has medical marijuana reciprocity with other states. This was established on the 1st of July, 2020. Under Senate Bill 139 (SB 139), patients who qualify for their home state medical marijuana program can use their valid medical marijuana card to purchase cannabis at licensed New Mexico dispensaries.

SB139 was passed in response to a section of SB406 that changed the legal definition of a patient, inadvertently allowing non-residents to apply for New Mexico’s Medical Cannabis Program. Under SB 139, non-residents will not be able to renew their New Mexico medical marijuana card, but can use a valid MMJ card from their home state.
