Legal Topics
Delta-8, delta-10, and other psychoactive, hemp-derived cannabinoids are illegal in Arizona. Their use, possession, sale, distribution, and production are prohibited in the state due to concerns about the unregulated market and minors’ use of these products.
Recreational marijuana is legal for adult use in Arizona. For those 21 or older, possession of up to 1 ounce (28 g) of marijuana (with no more than 5 grams being marijuana concentrate) or growing up to six marijuana plants at their home (with up to 12 marijuana plants in households with two or more adult members) is now legal.
Caregivers
Caregivers will need a completed physician’s attestation form, and they’ll require their completed application form, too. The process for a caregiver’s medical cannabis card is similar to the process for a patient.
Schools, colleges, and universities do not have to accommodate medical cannabis use on campus, although they cannot discriminate against medical cannabis cardholders when it comes to enrollment.
If you have designated a caregiver within the ADHS online system, your caregiver must also apply.
- Your patient application must be completed and approved before your designated caregiver can apply through the ADHS online system.
- Your caregiver will need your qualified patient registry identification card number, full name, and date of birth to begin the application process.
- Please note that your caregiver must also submit fingerprints to ADHS through the U.S. Mail as part of his or her application.
- Caregiver application fee: $200
Reciprocity
Arizona has medical cannabis reciprocity laws with some limitations. To buy cannabis with an out-of-state medical card in Arizona, you must qualify as a “visiting qualifying patient.” This means you must have an out-of-state medical cannabis card with a medical condition that satisfies Arizona’s medical cannabis requirements.
And if you’re an Arizona resident traveling elsewhere, the following states and U.S. territories also accept or recognize out-of-state medical marijuana cards:
- Arkansas *
- Hawaii *
- Louisiana
- Maine
- Michigan (at the dispensary’s discretion)
- Nevada
- New Hampshire
- New Jersey *
- New Mexico
- Oklahoma *
- Puerto Rico
- Rhode Island
- U.S. Virgin Islands *
- Utah * (up to two 21-day periods in a calendar year)
- Washington, D.C.
*Visitors must complete a visiting patient application with the state program.
States that have recreational cannabis for adults 21 and older but do not accept out-of-state cards include:
- Alaska
- California
- Colorado
- Connecticut
- Illinois
- Maryland
- Massachusetts
- Minnesota (currently only tribal dispensaries)
- Missouri
- Montana
- New York
- Oregon
- Vermont
- Washington
