Patients must be over the age of eighteen (18). If a patient is under eighteen (18) years of age, the patient must designate a custodial parent or legal guardian as the primary caregiver and also sign and complete the Minor Form along with the Patient Form during the application.

Patients must be a Rhode Island resident and provide proof of residency. Acceptable Documents are: Valid Driver’s License or Identification Cards issued by the State of Rhode Island, Vehicle Registration, Voters Registration, Correspondence From Another State Agency with Current Date or Current Car Insurance Bill.

Patients must obtain a Written Certification Form after an evaluation.

The Written Certification Form must show a diagnosis of a Qualifying Medical Condition.



Patients must then complete and sign a Patient Form and submit their Completed Application.
Patients must submit a Non-Refundable Application Fee of $50.00. If you are a recipient of Medicaid, SSI, SSDI, Federal Railroad Disability Benefit or Veteran’s Disability Photocopy of Medicaid Card, “ANCHOR” Card, the fee may be reduced to $25.00. Application Fee must be a Check or Money Order payable to RI General Treasurer.

All applications must be mailed to Rhode Island Center For Professional Licensing Room 105A – 3 Capitol Hill Providence, RI 02908-5097. Please keep a copy of the completed Application.

Once the application is submitted, the process will take two to four (2-4) weeks. Once approved, Medical Marijuana Identification Cards will be mailed to the address listed on the application.

How Do I Become a Medical Cannabis Caregiver in Rhode Island?

Patients who are under the age of 18 or otherwise unable to access medical cannabis themselves need a caregiver.


1. Must be 21 years old or older

2. Must live in Rhode Island and submit a copy of one item that proves you live in the state. The item must include your name and current address. Examples of items you can use are: ƒ Rhode Island driver’s license ƒ State ID ƒ Any correspondence from another state agency, current vehicle registration, car insurance bill or voter's registration.

3. Must get a copy of a National Criminal Information Center (NCIC) background check from a local police department, the Office of the Attorney General, or by appointment with the Rhode Island State Police (401-222-1110) ƒ The background check must include fingerprints. ƒ The law enforcement agency will send the background check results directly to RIDOH. ƒ If you had a background check from the NCIC in the past two years, you can send a copy with your application. ƒ RIDOH will not review your application until RIDOH receives your background check results. ƒ Applicants can be disqualified for felony convictions including, but not limited to, felony drug convictions.

4. Must pay a $100 non-refundable caregiver application fee. The fee is $25 if you send proof with your application that you receive one of these benefits: Medicaid; Supplemental Security Income (SSI); Social Security Disability Income (SSDI); Veterans disability; Federal Railroad disability. How Much Cannabis Can a Rhode Island MMIC Holder Grow?

Qualifying patients may possess up to 12 plants and 12 seedlings. All marijuana must be cultivated in one location. Must be stored in an indoor facility.

Two or more cardholders may cooperatively cultivate marijuana in residential or non-residential locations subject to the following restrictions:

Non-residential - no more than 10 ounces of usable marijuana, 48 mature marijuana plants, and 48 seedlings.

Residential - no more than 10 ounces of usable marijuana, 24 mature marijuana plants, and 24 seedlings.

Does Rhode Island Have Medical Marijuana Reciprocity?

Yes, Rhode Island does recognize other states' medical marijuana cards. Patients must bring a physical card (not a paper certificate or online recommendation) as well as a driver’s license from the same state as their medical license. All states in the US are allowed.

Those with a valid out-of-state medical marijuana card and with a debilitating medical condition, with a registry identification card (or its equivalent), are authorized to engage in the medical use of marijuana in Rhode Island.

Brief History of Rhode Island Medical Marijuana Laws

2005 - After much legal wrangling, Senate Bill 0710 (SB 0710) is passed through. It becomes known as the Edward O. Hawkins and Thomas C. Slater Medical Marijuana Act.

2007 - SB 791 is passed, removing the repeal date for the Rhode Island Medical Marijuana Act and expand the definition of a primary caregiver.

2009 - H5359 is passed and includes instructions for the sale, creation, administration and regulation of medical marijuana dispensaries.

2013 - The first compassion center (aka medical marijuana dispensary) is opened.

Possession limit is up to 2.5 ounces of cannabis for those with a valid medical marijuana recommendation and card.

Cultivation of up to 12 plants and 12 seedlings is allowed for those with a MMJ card. All plants must be grown in one location, and two or more cardholders may cultivate cannabis cooperatively.

No more than 48 mature plants, 48 seedlings and 10 ounces of usable marijuana can be grown cooperatively in a non-residential space.

In a residential space, no more than 24 mature plants, 24 seedlings and 10 ounces of usable marijuana can be grown.

For those without a medical marijuana card, possession of less than 1 ounce is a Civil Violation with no incarceration and a maximum fine of $150.

Possession of between 1 ounce and 1 kilogram of cannabis is a misdemeanor, with up to 1 year imprisonment and a $500 fine.

Possession of any more than 1 kg is considered “with intent to distribute”. This is a felony, and can bring a mandatory minimum sentence of 10 years and a fine of $500,000. Anything more than 5 kg of cannabis, and it’s 25 years-to-life for cannabis.

Cultivating cannabis may bring up to 30 years’ imprisonment and a fine of $100,000, if not more.

Penalties for hash and concentrates are the same as for marijuana.

Manufacture, sale, delivery or possession of paraphernalia is up to 2 years’ incarceration and a $5,000 fine.

Possession whilst driving will result in a suspension of up to 6 months.

The medical marijuana laws are similar across the board in Rhose Island. Possession of marijuana up to one ounce by a person age 18 years or older is a civil violation, punishable by a $150 fine, no jail time, and no criminal record. "Recreational marijuana does not appear to be coming to the state in 2020, but town planners want to be ahead of the game when it does.

A Planning Board subcommittee plans to discuss “possible local zoning regulation of various uses related to the cultivation, distribution and/or retail sale of marijuana products in town.”

Planning Director Ron Wolanski said no projects have been proposed to the town yet, but the subcommittee will be deliberating at the urging of the Town Council.

“The Town Council requested that the Planning Board and Town Solicitor draft potential regulations in anticipation of the possibility of recreational marijuana use, production and sale becoming legal in Rhode Island at some point in the future,” he wrote in an email.

The meeting will take place at Town Hall in the 2nd floor conference room on Friday at 3 p.m.

Gov. Gina Raimondo has said she plans to propose legalizing adult recreational use of marijuana in her upcoming state budget — as she did earlier this year. The General Assembly stripped that provision before it went back to the governor’s desk for signature though.

Senate President Dominick Ruggerio told the Providence Journal on Dec. 17 that he does not support legalizing recreational marijuana in 2020. He said he doesn’t think the state’s medical marijuana program has been well-regulated and expanding legal access to the drug any further is a bad idea."
